We have listed below important legal terms applicable to anyone using our services. These terms are necessary to protect both the User and the website, as well as to make our services possible and more efficient for everyone.

We understand that the legal terms can be tiring reading and we seek to make the experience more pleasant, considering it as a contract between the parties, where the contracting of the service by the user characterizes the complete acceptance of all content and terms present here, with both parties committing to honor and follow them.

For a summary list and central idea, to guide our legal terms and conditions of use, we need to explain the basic logic of the service provided by PRAIA.SITE and the reason for such a service, in a few words:

“Manageable Website Rental – No high creation costs”

Therefore, following these terms and the contracting of PRAIA.SITE services, the client will be renting a website for a determined period in the contracted plan, with the difference being a low cost of developing the structure and initial layouts, compared to the development of an own website with complete rights not only over the content but over the programming logic involved and own and third-party rights acquired, these having a much higher value than the website rental described in these terms.

 

DEFINITIONS:

GNU/GPL: General Public License, or simply GPL, is a license in use by free software projects (open source).

WordPress: It is a web content management system under GNU/GPL license, written in PHP language and running on MySQL database. It is used as a website development platform due to its extension capacity through plugins, themes and structured programming.

Semi-personalized website: PRAIA.SITE uses a purchased commercial theme, already used previously, and customizes the Logo, Background and Colors for the CLIENT. Insertion of final content is the customer’s responsibility.

WEBSITE: In this contract, it refers to a set of internet pages in Portuguese (or others, through the installation of a language plugin with automated translation, if the client chooses), operating at the same URL address, with initial content to be inserted by PRAIA.SITE and the remainder (surplus) managed by the CLIENT itself. The initial content to be inserted by PRAIA.SITE is limited to 5 structural pages or 8 total hours of development.

FTP: File Transfer Protocol is used to access WEBSITE files in the development environment by accessing the source codes.

CLAUSE ONE: OBJECT

1.1 The purpose of this contract is the installation, configuration and customization of a WEBSITE rented on the WORDPRESS platform for use exclusively within the PRAIA.SITE hosting server and platform structure.

1.2 The WEBSITE will be installed at the address (URL) of the subdirectory owned by PRAIA.SITE, to preserve the source codes, plugins and customizations developed by PRAIA.SITE.

1.3 The CUSTOMER may use its own domain to access the WEBSITE, that is, have a personalized URL address, directing to the URL of the WEBSITE contracted with PRAIA.SITE.

1.4 The space for storing files on the initial website is 20MB, which may vary depending on contracted plans (see plan link for more information at: https://praia.site/preco/). If necessary, the customer may choose to hire additional space, according to the plan upgrade options available in the customer’s area.

CLAUSE TWO: PRICE AND CONTRACTING

2.1 For providing the Manageable Website Rental service, PRAIA.SITE will charge as follows:

a) Charges, recurrences and values will be measured via plans purchased by the customer at the link: https://praia.site/preco/
b) According to personalized options chosen by the customer, additional amounts may be charged, depending on each item contracted or the website profile. The list of billable items is available for consultation via the link: https://praia.site/preco/

2.2 Structural modifications not available under the theme are not included in any of the contract options.

CLAUSE THREE: PAYMENT METHODS AND DEADLINES

3.1 Payment must be made using the options available in the Invoice Send email or sent directly via Telephone/WhatsApp. This email will be sent to the CLIENT’s registration emails at least 7 (seven) days before each due date.

3.2 Late payment generates a fine of 2% of the invoice value, and after 7 (seven) days of delay, the payment will be suspended.

CLAUSE FOUR: PRAIA.SITE’S RESPONSIBILITIES

4.1 During the development of the WEBSITE on the WORDPRESS platform, PRAIA.SITE will perform the following actions: i) creation of a CLIENT subdirectory; ii) initial WORDPRESS configuration; iii) theme installation; iv) theme customization according to the option selected by the CLIENT; v) utilization of features offered by the theme; vi) installation of security updates and new features on the WORDPRESS platform.

4.2 For security reasons, neither the CLIENT nor THIRD PARTIES shall have the right to access FTP or the source code of the WEBSITE or WORDPRESS files—whether merely for viewing or for installing themes, plugins, or services other than those already provided by PRAIA.SITE on its platform. The CLIENT may manage the WEBSITE’s content—and only its content—using the username and password provided by PRAIA.SITE.

PRAIA.SITE is not liable for:

4.3 Malfunctions of third-party services (such as the operation of the theme, WORDPRESS, plugins, themes, cross-browser compatibility, search tools, etc.) that result in any type of loss or unavailability of the contracted WEBSITE.

4.4 Damages suffered by the CLIENT resulting from malfunctions in their own connection, misuse of the internet, or issues with their internet network.

4.5 Indirect losses incurred by the CLIENT due to potential WEBSITE failures.

4.6 Changes to the guidelines of WORDPRESS, themes, or plugins used; PRAIA.SITE reserves the right to modify WEBSITE features, text, or images if necessary to comply with said guidelines. The CLIENT will be notified in advance via the email addresses provided in their registration.

4.7 The configuration and stability of the CLIENT’s custom URL (domain) if hosted by another company. 4.8 The CLIENT may perform maintenance on the WEBSITE content. Content updates requested of PRAIA.SITE shall be handled via a separate agreement.

4.9 PRAIA.SITE is not responsible for ensuring the WEBSITE appears in search engine results every time a search term is used, nor for ensuring the WEBSITE is always visible when searched for, given that search engines display results based on their own specific parameters.

CLAUSE FIVE: CLIENT RESPONSIBILITIES

5.1 Complete the questionnaire sent by PRAIA.SITE—following the initial payment—to the CLIENT’s registered email address and/or phone/WhatsApp number; the service cannot be developed without this information.

5.2 Make payment for the Manageable Website Rental Service by the due date to ensure the WEBSITE remains online and maintains its reputation with search engines.

5.3 The CLIENT is responsible for the WEBSITE content. PRAIA.SITE bears no liability if the WEBSITE content is illegal or infringes upon third-party rights; such violations may result in legal sanctions and summary deactivation of the site.

5.4 Pay for annual hosting and the annual domain registration fee if a custom URL (domain) is used.

5.5 Submit the content required to launch the WEBSITE to PRAIA.SITE, along with the completed questionnaire sent after the initial payment.

5.6 If the CLIENT delays submitting the initial materials, PRAIA.SITE reserves the right to insert placeholder/demo content and consider the development phase complete.

5.7 The CLIENT is responsible for the information to be included on the WEBSITE, including the provision and correction of text and processed images (in editable file formats), as well as all liabilities regarding copyright and other legal implications associated with publishing such content. CLAUSE SIX: DELIVERY TIMEFRAME AND MODIFICATIONS

6.1. Following the initial payment and the CLIENT’s submission of the correctly completed questionnaire and initial content, PRAIA.SITE shall have a maximum period of 30 (thirty) days to develop the layout for the contracted service. The Client must keep payments up to date, even in the event of a deadline extension.

6.2. After the layout is delivered, the Client may request minor textual adjustments; the volume of such requests may extend the delivery timeframe. At no point will PRAIA.SITE make technical changes to the site’s structure or layout—so as to avoid extending the timeframe or increasing costs, and to prevent compromising proper functionality and visual presentation across all devices and currently active web services (including those the CLIENT may not be aware of). The CLIENT agrees to rely on the expertise of the professionals involved, based on the PRAIA.SITE portfolio previously presented; such a website can be offered at such an affordable price precisely because it entails limited customization and utilizes pre-existing themes.
